Terms & Conditions
The terms that govern quotes, contracts, payment, variations, and our 12-month workmanship warranty.

These Terms & Conditions ("Terms") govern your use of the L W Construction website (lw-construction.co.uk) and any services provided by L W Construction. By engaging us for services, you accept these Terms.

2. Quotes
- Quotes are free, no-obligation, and typically provided within 48 hours of a site visit (3-7 working days for complex new builds).
- All quotes are itemised and given in writing.
- Quotes are valid for 30 days from the date of issue unless otherwise stated.
- Quotes are based on the scope, materials, and site conditions discussed at the site visit. If scope, materials, or conditions change before work begins, the quote may need adjustment — we will agree any changes with you in writing before the work starts.
3. Engagement and Contract
- Engagement begins when you sign and return our written quote, or otherwise confirm in writing that you accept the quoted terms.
- A signed quote constitutes the contract between us. The contract incorporates these Terms and the agreed scope, price, and timeline.
- Material orders typically require a deposit equal to the materials' cost; remaining payment is staged at agreed milestones.
4. Variations
- Any changes to the agreed scope during the build are documented in writing as a Variation Order.
- Variations specify the change, the impact on cost, and the impact on timeline.
- You must sign the Variation Order before the variation work is carried out. No variation is undertaken without your written agreement.
- Verbal agreements alone are not sufficient — every variation requires a written and signed record.
5. Payment
- Payment terms are stated in the signed quote.
- Typical structure: deposit on materials at project start, staged payments at agreed milestones (e.g. groundworks complete, structure complete, weather-tight, completion), balance on completion.
- Payments are made by bank transfer to the account specified on our invoices. Card payment available for smaller jobs.
- Invoices are due within 7 days of issue unless otherwise stated.
- Late payment may result in suspension of work and recovery costs in line with the Late Payment of Commercial Debts (Interest) Act 1998.
6. Timeline and Delays
- Quoted timelines are estimates based on normal weather, material lead times, and trade availability.
- Genuine delays (specialist material backorder, exceptional weather, unforeseen ground conditions) are flagged to you in writing as soon as we identify them.
- We do not accept liability for consequential losses arising from delays beyond our reasonable control.
7. Materials
- Materials are sourced from trade suppliers we trust unless you specify particular suppliers in the contract.
- Where you supply materials directly, we accept no liability for material quality or suitability — this risk transfers to you.
- Materials remain our property until paid for in full.
8. Sub-Contractors
- We engage qualified sub-contractors for trades requiring specific certification — Gas Safe plumbers, registered electricians, structural engineers.
- Sub-contractors are insured separately and certify their own work.
- We are responsible for coordinating sub-contractors on your project. They are not party to our contract with you.
9. Workmanship Warranty
- We provide a 12-month workmanship warranty from the date of completion on all building work we directly perform.
- The warranty covers defects in our workmanship arising during the 12-month period.
- The warranty does not cover: defects in materials supplied by you, fair wear and tear, damage caused by misuse or third-party work, work undertaken by sub-contractors (which is warrantied separately by each sub-contractor).
- Warranty claims must be made in writing within 12 months of completion. We will inspect and, where the claim is valid, remedy the defect at no cost.
10. Insurance
We carry the following insurance cover:
- Public Liability: £1,000,000 via Zurich Insurance through Trade Direct (Kelliher Insurance Group), policy reference GQ638300/223602.
- Professional Indemnity: £100,000.
- Financial Loss: £100,000.
Insurance certificate is available on request.
Note on Employers Liability: L W Construction's current insurance documents do not show Employers Liability cover. This is consistent with a no-paid-employee setup. If paid employees are taken on in future, Employers Liability cover must be put in place as legally required.
11. Cancellation
- You may cancel before work begins by giving written notice. We will refund any deposit paid less reasonable costs incurred (typically material orders that cannot be returned).
- Once work has commenced, cancellation entitles us to payment for work completed plus reasonable costs incurred.
- We may cancel and refund (less work completed) if we discover that the scope, ground conditions, or specification is unsafe or outside our insurance.
12. Disputes
- We aim to resolve any concerns by direct discussion in the first instance. Contact Luke directly on 07749 468160 or by email.
- If a dispute cannot be resolved by discussion, both parties agree to seek mediation before initiating any legal proceedings.
- These Terms are governed by the laws of England and Wales. The Courts of England and Wales have exclusive jurisdiction.
13. Limitation of Liability
- Our total liability under any contract is limited to the value of that contract.
- We are not liable for indirect or consequential losses.
- Nothing in these Terms excludes liability where exclusion is prohibited by law (death, personal injury, fraud).
14. Privacy
Our handling of your personal data is governed by our Privacy Policy.
15. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be communicated to existing customers.
